Thanks to Biodiesel, INDONESIA can no longer import diesel

PT Pertamina (Persero) has supported the government in distributing biodiesel since 2006
and it turns out that this has experienced a significant development. "In 2006 it was still a small 0.11 million KL, the growth trend will increase significantly until 2020. Estimates are that in 2021 it will reach 81 million KL," said Director of Business Development of PT Pertamina Putra Niaga, Mars Ega Legowo Putra in the Energy Corner "Biodiesel for Energy Independence". During the pandemic, he continued, precisely in mid-2020 until the end of the year, daily biodiesel sales continued to increase. Currently there are 114 terminal locations for bio-diesel. Furthermore, blending biodiesel, namely to mix fossil oil-based diesel and vegetable fuels in the form of Fatty Acid Methyl Esters (FAME), Pertamina noted that until May 2021 the absorption reached 2.9 million KL. Pertamina's import trend is decreasing. Even in 2020, zero imports, aka no imports of diesel. "2019 is really minimal. 2020 is zero. In terms of energy independence, especially solar and Indonesia's macroeconomic conditions are good," he said. For information, Pertamina continues to strive to increase the supply of palm oil-based diesel (Crude Palm Oil / CPO) or known as green diesel (D100) from domestic refineries, so as to ensure the sustainability of the biodiesel program and consistently reduce imports of fuel oil (BBM)

He said, this year, the national economy will begin to recover. "In 2022, various opportunities for transformation and better economic growth, especially in the field of green economy and information technology, the Covid-19 pandemic condition and its handling are still the determining factors for the national economic recovery. Government Moves Quickly to Revise Regulations

The two-year time limit given by the Constitutional Court to revise Law Number 11 of 2020
concerning Job Creation has made the government seek to move quickly to complete the revision of regulations governing the formation of laws and regulations. To follow up on the decision of the Constitutional Court (MK), the government and the House of Representatives (DPR) have agreed to revise Law Number 12 of 2011 concerning the Establishment of Legislations (PPP). The second amendment bill to Law No. 12/2011 was ratified as a DPR initiative bill at a plenary meeting. The DPR has not yet submitted the proposal for the discussion of the PPP Bill to the government. Head of the National Legal Planning Center of the National Legal Development Agency of the Ministry of Law and Human Rights (Kemenkumham) Djoko Pudjirahardjo said that the government will make an inventory list of problems (DIM) of the PPP Bill after the DPR officially submits a proposal to the government. The Director of Harmonization of Legislation I Directorate General of PP Kemenkumham Roberia added, if the DPR's letter has been received, the President will assign the Minister of State Secretary (Mensesneg) to discuss it with the relevant ministers. After that, the President will submit a letter of approval for the discussion to the DPR

Property Incentives Can Be Ineffective

Head of the Fiscal Policy Agency, Febrio Kacaribu, explained that the PPN DTP incentive for the housing sector for 2022
is given for nine months for the delivery of landed houses and flat housing units. The handover of the unit, among others, occurs when the deed of sale and purchase is signed, or the sale and purchase agreement is signed in full before a notary, as well as the transfer of the right to use or control the landed house or apartment ready for habitation. The DTP VAT incentive is given 50 percent of the VAT payable on the delivery of landed houses or flats with a maximum selling price of IDR 2 billion. For the price of landed houses or flats above Rp. 2 billion to Rp. 5 billion, the incentive is set at 25 percent of VAT. "We hope that the community will take advantage of this incentive to help the Indonesian economy recover stronger in 2022," said Febrio, General Chair of the Indonesian Real Estate DPP (REI) Paulus Totok Lusida, assessing that the extension of the DTP VAT incentive until September 2022 was in accordance with the agreement with the developer. However, its implementation this year is feared to be difficult to be effective due to licensing constraints, namely the transition from a building permit (IMB) to a building approval (PBG). PBG management refers to Government Regulation (PP) Number 16 of 2021 concerning Implementing Regulations of Law No. 28/2002 concerning Buildings. PBG is a permit granted to building owners to build new, modify, expand, reduce, and/or maintain buildings in accordance with building technical standards. Totok said that the government's decision to replace the IMB to PBG since August 2021 has not yet been followed up with a regional regulation (perda).

Looking for a Stamp to the Four Cities

The House of Representatives moved quickly to save the omnibus law of the Job Creation Act.
After being declared unconstitutional by the Constitutional Court in November 2021, the DPR immediately proposed the process of changing the Law on the Establishment of Legislation. This revision of the PPP Law cannot be separated from its position which became the basis for consideration of the Constitutional Court when it stated that the Job Creation Law was formally flawed. Prior to agreeing on the revision of the PPP Law as a proposal by the Legislative Body of the DPR in yesterday's plenary session, the DPR Expertise Board held a virtual tour to solicit opinions from academics last week. From Lampung, Bandung, Yogyakarta, Surabaya, to Makassar. However, the list of virtual discussion sources raises a question mark. Because, there are many professors of law, but not constitutional law. There are even business and agrarian law experts. Of the total 21 law professors, seven of them are not constitutional experts. In fact, what is clearly being discussed is the plan to amend Law Number 12 of 2011 concerning the Establishment of Legislation. To Tempo, the Head of the Expertise Board of the DPR, Inosentius Samsul, said that the public consultation tour regarding the revision of the PPP Law did invite legal experts outside of state administration for a more comprehensive discussion. According to a constitutional law expert from Padjadjaran University, Indra Perwira, who rejected the invitation, the problem was not in the Law for the Establishment of Legislation, but in the Job Creation Act. However, the DPR actually questioned the PPP Law to accommodate the omnibus law. "I see this problem being deflected by them," he said.

Foreign Exchange Reserves Depressed Coal Export Ban

The position of foreign exchange reserves at the end of January 2022 decreased by US$3.6 billion compared to the position in December 2021.
Bank Indonesia (BI) noted that the position of foreign exchange reserves in January 2022 was US$141.3 billion, down from the previous month's position of US$144. .9 billion. BI said that the decline in foreign exchange reserves was influenced by the need for payment of government foreign debt and the reduction in foreign currency placements by banks at BI, in anticipation of the need for foreign exchange liquidity in line with improving economic activity. Bank Mandiri economist Faisal Rachman said the last coal export ban policy also helped to restrain the increase in foreign exchange reserves in January 2022. "We see that the decline in foreign exchange reserves in January 2022 was also partly due to a decline in exports amid the coal export ban to fulfill the Domestic Market Obligation [DMO]. , ". Faisal views, this year's foreign exchange reserves will remain high, although not as high as last year. This is due to the current account balance which is predicted to experience a deficit again, in line with imports which are expected to increase. Meanwhile, Indonesia's balance of payments is estimated to still record a surplus this year, although not as high as last year.

Bappenas Describes RI's Biggest Challenges in Transitioning to a Green Economy

The National Development Planning Agency (Bappenas) describes the challenges Indonesia faces in its transition to a green economy.
Deputy for Economics at Bappenas Amalia Adininggar Widyasanti revealed that one of the biggest challenges is the dependence of the economy and exports on coal which makes it difficult for Indonesia to switch to the use of New and Renewable Energy (EBT). "If we look at the share of our non-oil and gas exports, one of them that contributes the most is coal and crude palm oil. But then if we look at the energy sector, some of them still use coal as their energy," said Widyasanti, who is familiar with called Winnie, at the webinar Indonesia's Green Jobs Conference which was held . If we examine more deeply, some provinces still depend on the coal mining sector for their economy. This is because the price of coal energy is relatively cheaper than NRE. "The market still believes that coal is a relatively cheap energy source and therefore of course research and development for us to be able to obtain cheaper renewable energy technologies will be a big challenge in the future," he said.

APBI Ensures All Members Have Returned to Carrying Out Coal Exports

The Indonesian Coal Mining Association (APBI) ensures that all member companies are now able to export coal. Previously, the government as of February 1, 2022 ensured that it had lifted the export ban policy that was implemented throughout January 2022.
APBI Executive Director Hendra Sinadia explained, after the lifting of the export ban by the government, export activities by APBI member companies have resumed. Hendra continued, the export ban last January caused delays in shipments for the export market. "Big companies may be able to do it in March, maybe it can only be completely normal (like) before the export ban," explained Hendra. Nevertheless, Hendra ensured that each company's situation was different depending on the existing export volume. On the other hand, the Ministry of Energy and Mineral Resources previously issued the Decree of the Minister of Energy and Mineral Resources Number 13 of 2022 concerning Guidelines for the Imposition of Administrative Sanctions, the Prohibition of Selling Coal to Foreign Affairs and the Imposition of Fines and Compensation Funds for Fulfilling Domestic Coal Needs. This rule, among others, regulates the imposition of sanctions for coal companies that do not fulfill their Domestic Market Obligation (DMO) commitments.

Terbit Perangin Angin Admit the Victim Died

The National Human Rights Commission (Komnas HAM) will summon experts to prove the alleged criminal acts of trafficking in persons and slavery at the house of the Langkat Regent.
The Commissioner for Monitoring/Investigation of Komnas HAM, Choirul Anam, is targeting to complete the construction of the case that dragged the official involved in the bribery case this week. "So we can see this is a case of modern slavery, TIP, or other cases," said Anam after examining Terbit, who was detained at the Corruption Eradication Commission (KPK) building, Jakarta, yesterday. "That's what we're testing." After recommending the North Sumatra Regional Police regarding the alleged violence at Terbit's house, Komnas HAM will oversee the police investigation process. Komnas HAM is also investigating Terbit's direct involvement in the violence. Anam indicated the regent was involved in other crimes, but he would not publish it yet. According to commissioner Beka Ulung Hapsara, who co-examined Terbit, the regent said the cell was a training ground for drug addicts. Terbit also admitted that these people were employed in his oil palm plantations so that they would have skills when they came out of rehabilitation.

Considering the Ideal Pricing Plan

Business actors begin to prepare their proposals. It is hoped that a comprehensive policy evaluation will be able to maintain the resilience of the emerging mining industry.
The Indonesian Coal and Energy Suppliers Association (Aspebindo) proposed that the price of coal for domestic needs (do-mestic market obligation/DMO) be adjusted to US$90 per tonne. Price disparity is one of the considerations for the proposal. "At the beginning of the year, we plan to submit [the proposal officially to the government]," said Aspebindo Chairman Anggawira to Bis-nis, last weekend. Currently, the price gap between exports and domestic prices is quite far. The special price for domestic power plants is set at US$70 per tonne. This figure has not changed since it was first set in 2018. Based on the ICE Newcastle exchange, coal prices in the global market have touched US$169.40 per metric ton for December contracts and US$171.60 per metric ton for January 2022 contracts. DMO with a global market price of around US$100 per metric ton. Meanwhile, the government recently increased the scope of the special price for the cement and fertilizer industry by US$90 per tonne each. “Moreover, there is an increase in the price of non-electric [coal]. Maybe it should be better if it can be the same between non-electric and DMO electricity," he explained. He also assessed that the determination of the ideal price for electric fuel needs special formulations and formulations.

Reduced Handling of Natural Resources Corruption

The decline in the performance of the Corruption Eradication Commission has an impact on the handling of natural resource cases.
Evaluations by Indonesia Corruption Watch (ICW), the Center for Anti-Corruption Studies at Gadjah Mada University (Pukat UGM), and Transparency International Indonesia (TII) show that over the past two years, the KPK has rarely touched this sector. "In fact, based on the 2012-2023 KPK roadmap document, natural resources are included in a strategic sector that needs to be addressed by the KPK," said ICW researcher Kurnia Ramadhana, in Jakarta, yesterday. He said that one important KPK program that had begun to recede was the National Movement to Save Natural Resources or GNPSDA. The program covers governance improvements, from licensing to incentives to accelerate policy implementation. All of these efforts, said Kurnia, are ultimately aimed at minimizing opportunities for corruption and saving state finances. According to Kurnia, there are still many actors who are looking for profit in the midst of the complexity of governance issues in the natural resources sector. One of them is coal mining. Constitutional law expert Bivitri Susanti said the weakening of the KPK was carried out legally. Not only the KPK, the weakening of the DPR, civil society, and the Constitutional Court was also carried out. With the reduced spurs of these four lines of supervision, control over power no longer exists. "What we are seeing is part of a big scenario. The government is controlled by one person and few people," he said. According to Bivitri, the ultimate goal of autocratic legalism is not to revise the KPK Law, but to facilitate economic activities for the benefit of the authorities.

Ensure Environmental Recovery Runs in the Field

The Ministry of Environment and Forestry or KLHK has handled 941 legal cases from various complaints. Of these, 518 cases have been administratively sanctioned.
Director General of Law Enforcement (Gakkum) Environment and Forestry KLHK Ratio Ridho Sani said, as many as 941 cases consisted of 488 companies and 453 non-companies. The administrative sanctions that have been given for 518 cases are government coercion for 207 cases, 297 warning letters, and 14 written warnings. “The number of law enforcement is quite intensive because the Ministry of Environment and Forestry has a specialist unit. So, the institutional side can also be a reflection if we want to strengthen the enforcement of natural resources," he said at the KLHK year-end reflection event in Jakarta. was subject to administrative sanctions. While the civil cases that have been resolved since 2015-2021 were 31 lawsuits and 25 of them were won by the Ministry of Environment and Forestry. This civil lawsuit has even resulted in compensation for environmental restoration amounting to Rp 20.7 trillion. Executive Director of the Indonesian Institute for the Study of Environmental Law (ICEL) Raynaldo Sembiring said, as a transformation step, in the future it is necessary to first define the goals of restorative justice in the environment and forestry sector. This restorative justice should not only be related to the termination of the case, but also the complete completion of law enforcement. This means that new cases are declared completed after restoration or environmental restoration actions are carried out.

DKI Opens UMP Adjustment Room

The DKI Jakarta Provincial Minimum Wage in 2022 was finally decided to increase by 5.1 percent based on the Decree of the Governor of DKI Jakarta Number 1517 of 2021.
The provincial government hopes that the decision will provide a sense of justice even though it was decided without an agreement between workers and employers as employers. In deciding this matter, the tripartite consisting of the DKI Jakarta Provincial Government, representatives of workers, and entrepreneurs has held an online meeting with the wage council. Head of the Manpower, Transmigration, and Energy Office of DKI Jakarta Province, Andri Yansyah, revealed that the meeting did not find an agreement. “The times when there was no agreement were not only this year, there were also no last years. However, we involve all relevant parties. Then, the governor must decide," he said when met on the sidelines of a meeting with Commission B of the DKI Jakarta Regional People's Representative Council (DPRD), in Central Jakarta. Andri said DKI did not have the flexibility to make city/district minimum wages (UMK) like other provinces in setting wages according to regional capabilities. As a special region, DKI has the right to determine its own policies. "God willing, this UMP (revision) will provide a sense of justice and increase purchasing power to improve the economy," said Andri.

Tax Voluntary Disclosure Will Be Interested

It is believed that the taxpayer's voluntary disclosure program will be in demand because of the low rates and the opportunity to be free from administrative sanctions.
To encourage legal certainty, taxpayers can only take advantage of this facility prior to legal action and investigations related to tax crimes. The government has stipulated Minister of Finance Regulation (PMK) Number 196/PMK.03/2021 concerning Procedures for Implementing the Taxpayer Voluntary Disclosure Program on December 22, 2021, then promulgated the PMK on December 23, 2021. The regulation is an implementing regulation for the voluntary disclosure program that has been stated in the Law on Harmonization of Tax Regulations (UU HPP). This program will take effect on January 1, 2022 until June 30, 2022. Monday (27/12/2021), Director of Counseling, Services and Public Relations, Directorate General of Taxes, Ministry of Finance, Neilmaldrin Noor, is optimistic that the interest of taxpayers (WP) to participate in the disclosure program volunteering will be high. The reason is, this program provides an opportunity for taxpayers to be free from administrative sanctions. "WP will also get data protection that the disclosed property data cannot be used as a basis for investigation, investigation, or criminal prosecution of WP," he said. There are two voluntary disclosure schemes. First, the payment of income tax is based on the disclosure of assets that are not or have not been fully reported by participants of the tax amnesty program. The second scheme, based on the disclosure of assets that have not been reported in the Annual Income Tax Return (SPT) for personal income tax year 2020.

Luhut said that the Emergency PPKM issue would be extended

The Coordinating Minister for Maritime Affairs and Investment (Menko Marves) who is also the Coordinator for the Enforcement of the Emergency Java-Bali Community Activity Border (PPKM) Luhut Binsar Pandjaitan responded to the issue of the extension of the Java-Bali Emergency PPKM. Luhut didn't talk much. He only said that the spike in Covid-19 cases had been predicted beforehand.
However, it was unexpected that the spike in cases occurred so quickly. "I think it's like this, we suspected that this skyrocketing case might also happen but we didn't expect it to be so frankly this fast. But behind our understanding of this Delta variant, many don't really understand it," said Luhut via the Presidential Secretariat's YouTube channel, "No. We are just surprised, many other countries have been affected because medical science has not yet reached it," he continued. Luhut said his party was observing the economic impact of implementing Emergency PPKM. Therefore, the government will observe conditions before determining how long the Emergency PPKM will run.

Environmental Law Needs Strengthening

Executive Director of the Indonesian Institute of Environmental Law Studies (ICEL) Raynaldo Sembiring said, ICEL sees that 2022 is an important year for the development of environmental management in general.
This development also includes environmental law in the context of policy, law enforcement, protection of community rights, and other substances that affect it. "In last year's outlook, we projected that there would be three situations that would occur, namely dynamics related to SLAPP (violation of community rights), law enforcement due to unclear regulations, and the ratification of the Job Creation Act which was drafted in a hurry," he said during the outlook event. According to Raynaldo, these three situations have become the basis for ICEL to develop an environmental law outlook for 2022. These three situations are also considered very relevant to the dynamics related to environmental law that are currently happening and in the future. . The policy that is seen as getting a lot of criticism is the derivative rule of Law Number 11 of 2020 concerning Job Creation. The potential for criticism of this derivative rule will be great if the government only evaluates or reforms it formally after the conditional unconstitutional decision from the Constitutional Court (MK), November 2021. Director of Criminal Law Enforcement at the Ministry of Environment and Forestry Yazid Nurhuda admits that currently there are a number of challenges related to environmental law norms after the ratification of the Law Job Creation, one of which is the addition of administrative sanctions in the form of fines. This provision has been further regulated in a government regulation derived from the Job Creation Law and is currently being detailed in a draft regulation by the minister of environment and forestry.
