Looking for a Stamp to the Four Cities
The House of Representatives moved quickly to save the omnibus law of the Job Creation Act.
After being declared unconstitutional by the Constitutional Court in November 2021, the DPR immediately proposed the process of changing the Law on the Establishment of Legislation. This revision of the PPP Law cannot be separated from its position which became the basis for consideration of the Constitutional Court when it stated that the Job Creation Law was formally flawed. Prior to agreeing on the revision of the PPP Law as a proposal by the Legislative Body of the DPR in yesterday's plenary session, the DPR Expertise Board held a virtual tour to solicit opinions from academics last week. From Lampung, Bandung, Yogyakarta, Surabaya, to Makassar. However, the list of virtual discussion sources raises a question mark. Because, there are many professors of law, but not constitutional law. There are even business and agrarian law experts. Of the total 21 law professors, seven of them are not constitutional experts. In fact, what is clearly being discussed is the plan to amend Law Number 12 of 2011 concerning the Establishment of Legislation. To Tempo, the Head of the Expertise Board of the DPR, Inosentius Samsul, said that the public consultation tour regarding the revision of the PPP Law did invite legal experts outside of state administration for a more comprehensive discussion. According to a constitutional law expert from Padjadjaran University, Indra Perwira, who rejected the invitation, the problem was not in the Law for the Establishment of Legislation, but in the Job Creation Act. However, the DPR actually questioned the PPP Law to accommodate the omnibus law. "I see this problem being deflected by them," he said.
