The Ownership of Smallholders' Palm Oil Plantations is Less, Private Companies Are Getting Bigger

The Business Competition Supervisory Commission (KPPU) found that national or community ownership of oil palm plantations was decreasing. On the other hand, private ownership of oil palm plantations is increasing.
KPPU's Commissioner, Ukay Karyadi, said that throughout 2021 there were a number of acquisitions by private companies. It was carried out against a national oil palm plantation company. "From the KPPU's own data, last year there were 10 acquisitions of palm oil plantations by larger companies. In which 5 Malaysian companies acquired national companies, on the other hand, Malaysian (companies) acquired Malaysian (companies)," he said in Indef's virtual discussion, "So the more the sovereignty of the oil palm plantation decreases in terms of ownership. People's ownership is decreasing, national ownership is also decreasing. This needs to be a concern for all," he added. With the acquisition, he said, the percentage of ownership of oil palm plantations managed by the community also decreased. This is a domino effect that occurs in the upstream sector. "Every year, people's ownership decreases because they are taken by medium-sized companies. Every year, medium-sized companies also decrease because they are acquired by large companies," he said.

INDONESIA Economic Endurance Test

Although the supply of coal for domestic needs during February is guaranteed to be safe, the government still does not want to take the risk of another scarcity in the domestic market.
As a result, the implementation of the domestic market obligation or coal DMO has now been changed to monthly. Not only that, PT PLN (Persero) also changed the coal supply contract, which was all short-term into long-term. Purchase schemes are no longer made through traders but directly on miners. The rules of the game regarding the new DMO are contained in the Decree of the Minister of Energy and Mineral Resources No. 13/2022 concerning Guidelines for the Imposition of Administrative Sanctions, Prohibition of Sales of Coal Overseas and the Imposition of Fines and Compensation Funds for Fulfilling Domestic Coal Needs. In the eighth dictum of the regulation, it is stated that the results of the evaluation of the coal sales report for domestic needs are submitted by the Mining Business Entity every month. President Director of PT PLN (Persero) Darmawan Prasodjo emphasized that this step was taken by the government in order to maintain compliance for mining companies. They will not get an export permit if they do not meet the DMO requirements. "We make sure to guarantee that the coal crisis will not happen again," said President Director of PT PLN (Persero) Darmawan Prasodjo during a Hearing Meeting with Commission VII DPR. in maintaining supply and enforcement of the rules of the game. “The existence of Ministerial Decree 13/2022 will strengthen the government's position in providing rewards and punishments. Because of this, it is clear that there is a fine in its implementation.”

China Don't want the energy transition to have an impact

Chinese President Xi Jinping announced the stance before members of the political field of the Central Committee of the Chinese Communist Party. In a speech published on Tuesday night (1/25) Beijing time, Xi stressed that cutting carbon emissions is not at all the same as eliminating emissions or lowering productivity.
It is very important to ensure alignment towards development and transition targets. According to Xi, the transfer of energy sources should be based on the availability of new sources. Do not leave the old energy source until the new energy source is available. "China must control its consumption of fossil fuels," he said, as quoted by Xinhua. It is very important for China to ensure domestic energy supply and use it optimally. China must ensure the security of coal supply, keep the use of oil and natural gas growing in a controlled manner. On the other hand, Xi stressed the importance of spurring growth in the use of renewable energy. He also said that China must promote the safe and orderly use of nuclear power. The combination of increasing the use of renewable energy and nuclear is expected to reduce the carbon emissions released by China.

Strategic Position for “President's Confidant”

Three former commanders of the Presidential Guard (Danpaspampres) under President Joko Widodo were promoted to three-star high-ranking officers. Two former assistants also got strategic positions.
The phenomenon of the "president" has become history repeating itself. The promotion is stated in the Decree Number 66/I/2022 dated January 21, 2022 concerning Dismissal from and Appointment in Position within the TNI which was signed by the TNI Commander General Andika Perkasa, Andika also previously had became Danpaspampres in 2014-2016 before becoming Chief of Staff of the Army in 2018-2021. The three former Paspampres commanders who occupy the three-star general position are Major General Agus Subiyanto, Major General Maruli Simanjuntak, and Major General (Mar) Suhartono. In addition to the three former Paspampres commanders, two former aides to President Joko Widodo also occupy strategic positions. Brigadier General Widi Prasetijono became the Commander General of Kopassus which is a Major General position. The commander of Korem 074/Warastratatama, Colonel Rudy Saladin, who has only been in office for four months, was also promoted to Commander of Korem Suryakencana, which is a brigadier general position. The phenomenon of "president's men" holding strategic posts is also not new. In the era of President Susilo Bambang Yudhoyono, for example, in 2008, the post of Pangkostrad was filled by Erwin Sudjono and the Danjen of Kopassus was held by Pramono Edhi Wibowo. Both are SBY's brother-in-law. The history of assignment to posts that are in direct contact with the President has long been one of the "paths" of promotion in the military.

The Irony of Palm Oil, Planted on State-Owned Land, Sold Expensively Domestically

Cooking oil prices are skyrocketing. The compact producers raise prices on the pretext of adjusting to the price of palm oil (CPO) in the global market. The spike in cooking oil prices in Indonesia is ironic, considering that the supply of palm oil in Indonesia is always abundant.
It is even listed as the largest CPO producing country in the world. In fact, large cooking oil producing companies are working on their oil palm plantations on state land granted by the government through the granting rights scheme (HGU). In fact, several HGUs for large oil palm plantations are located on former forest release lands. However, the government cannot force producers to lower the price of cooking oil which is included in the basic needs of the community. HGU is the provision of state-owned land to be managed by entrepreneurs to be used economically for a certain period of time in accordance with Law Number 5 of 1960 and its derivative regulations. The existence of the HGU itself is actually nothing but the embodiment of Article 33 of the 1945 Constitution, in which the earth and the wealth in it can be used as much as possible for the welfare of the people. In order for entrepreneurs to get HGU, there are a number of procedures that must be followed. HGU can be granted for land with an area of at least 5 hectares.

Ministerial Survey Results on the Presidential Candidate Exchange

President Joko Widodo has invited a number of politicians, some of them ministers, to campaign as presidential candidates for 2024.
He also has no problem with his ministers running for office as long as they do not interfere with their performance as ministers. "We want to have more candidates. Therefore, we provide equal space for everyone to introduce themselves," said President Jokowi, last Wednesday. He emphasized that for cabinet members, the most important thing is not to interfere with the daily work portion. "I don't want to be seen as blocking those who have the opportunity or wish to become presidential candidates," said the President. From the regional heads, there are. From the general chairman, there are. From the DPR, there are also," said Jokowi. There are at least four Jokowi ministers who are often on the radar of lists of potential presidential or vice presidential candidates released by a number of survey institutions. They include Coordinating Minister for the Economy Airlangga Hartarto, Minister of Defense Prabowo Subianto, Minister of Tourism and Creative Economy Sandiaga Uno, and Minister of SOEs Erick Thohir.

National Capital Move Agreed in 43 Days

The ratification of the National Capital City Bill or the IKN Bill into law will be followed by the preparation of a master plan as a guide for preparing, building, and transferring IKN and administering a special regional government for IKN.
Transparency and public oversight are needed in the preparation of the master plan. The IKN Bill was approved to be passed into law only 43 days after the House of Representatives (DPR) formed a Special Committee for the IKN Bill, 7December 2021. At the DPR Plenary Meeting, in Jakarta, of the nine factions in the DPR, only one faction, namely the Prosperous Justice Party faction, those who do not approve of the IKN bill are passed into law. The quick discussion raised questions from a number of groups regarding how much public input was ensured to be accommodated in the discussion of the IKN Bill. Chairman of the Special Committee for the IKN Bill, Ahmad Doli Kurnia Tandjung, said that the ratification of the IKN Bill was the first step in the agreement to move the nation's capital, which must be followed up with the preparation of a detailed master plan. Professor of Government Science at the Institute of Domestic Administration, Djohermansyah Djohan, reminded that the preparation of the master plan must be carried out transparently.

ESDM Ensures PLN's Coal Crisis Doesn't Hinder New Renewable Energy

Director General of New, Renewable Energy and Energy Conservation of the Ministry of Energy and Mineral Resources Dadan Kusdiana said the coal crisis that previously hit PLN's PLTU did not hinder the development of New Renewable Energy (EBT) in Indonesia.
"I see that there are no actual issues related to what is at PLN, whether it is related to the PLTU or oversupply," said Dadan at the 2021 Performance Achievement Press Conference and the 2022 EBTKE Subsector Work Plan. Dadan said that he was based on the approval of the revised Electricity Supply Business Plan (RUPTL) 2021-2030. The revision is the result of discussions between PLN and the Ministry of Energy and Mineral Resources. "This discussion has been completed, so the current RUPTL, which has now been approved by the ESDM minister, is based on an excess supply basis from PLN as well as the conditions for the use of coal," said Dadan. He added that in the revised RUPTL, the government and PLN have determined that the capacity for NRE power plants will be increased by 20.9 GW (gigawatts) until 2030. so I see this is not an obstacle," said Dadan.

Indonesia Needs to Raise the Issues of G-20 Communities

Civil society hopes that the Indonesian government will bring up relevant issues for developing-poor countries in the G-20 presidency in 2022. Moreover, President Joko Widodo has made a promise regarding this matter.
Non-governmental organizations that are members of the C-20 engagement group are currently working on initiatives that will be recommended to member countries of the G-20 group. Problems that are grounded and have a major impact on citizens in developing-poor countries are a top priority. "The menu offered must fit. That is, the proposal must be specific, measurable, and concrete, and supported by evidence. Don't make the problem too wide," said Executive Director of INFID (International NGO Forum on Indonesia Development) Sugeng Bahagijo who also leads the C-20 group in Jakarta. In various international forums, Indonesia is often trusted to represent the interests of poor and developing countries. President Jokowi at the Opening Ceremony of the G-20 Indonesia 2022 Presidency in Jakarta, emphasized that the 2022 G-20 Presidency will also be used to fight for the aspirations and interests of developing-poor countries.

Strengthening Food Security, ASEAN Needs a Bigger Private Contribution

The Center for Indonesian Policy Studies (CIPS) assesses that food security in the ASEAN region requires a larger private contribution, including through foreign direct investment (FDI).
Center for Indonesian Policy Studies (CIPS) researcher Azizah Fauzi said this needed to be done to strengthen food and agricultural supply chains and the region's position in global value chains. “This area requires more investment, including foreign direct investment in the food sector to ensure people's access and affordability to food. Food security in ASEAN is still vulnerable to price fluctuations and supply disruptions. This affects the food affordability of the people," said Center for Indonesian Policy Studies (CIPS) researcher Azizah Fauzi in her official broadcast, Azizah said, the realization of FDI in agriculture in ASEAN until 2020 was less than 10 percent of the total FDI in the region. FDI in the ASEAN agricultural sector has decreased since 2015 and the average annual FDI realization of agriculture to ASEAN in 2016 to 2019 was 26.89 percent lower than 2015. Azizah also said that the vulnerability of food security in ASEAN, among others, can be seen from the problem of food shortages. long-standing nutrition.

Tactics to Stimulate the Tax Ratio

Although last year the realization of the tax ratio or the tax ratio is below the target, the government's opportunity to penetrate the target figure set this year of 9.22% is quite open
in line with the implementation of Law no. 7/2021 concerning Harmonization of Tax Regulations (HPP). There is a great opportunity to reach this target because the government is referring to efforts to increase the tax ratio in a broad sense, which includes tax revenues, customs and excise, as well as non-tax state revenues (PNBP) of natural resources (SDA). Expert Staff to the Minister of Finance for Tax Compliance, Yon Arsal, said that the selection of the tax ratio in a broad sense is based on the calculations that have been applied by the fiscal authorities. "In our tax ratio, there are elements of BC and PNBP SDA," said Yon. The estimation of the projected tax ratio is determined by the Fiscal Policy Agency (BKF) of the Ministry of Finance using the basis of nominal gross domestic product (GDP). tax observers consider that the fiscal authority will face obstacles in exploring tax potential because the government uses the tax ratio in a broad sense as a measure of fiscal performance. Tax observer Center for Indonesia Taxation Analysis (CITA) Fajry Akbar said there are three risks that will be faced by the government, namely, first, the effectiveness of the Voluntary Disclosure Program (PPS) or Tax Amnesty 2022, which depends on the number of taxpayers who are participants. Second, there are no derivative rules related to the appointment of other parties as tax collectors. Third, optimizing the policy of preventing tax avoidance practices. "So, we need strategy and planning in implementation in order to be able to encourage the tax ratio," he said

President Jokowi Decides the Discount for Property Value Added Tax for 2022 Maximum of 50 Percent

President Joko Widodo (Jokowi) finally approved the budget allocation for the 2022 Government-borne Value Added Tax (VAT) funds.
This was conveyed by the Minister of the Economy Airlangga Hartato in a Ministerial Press Statement regarding the Results of the Limited Meeting on PPK Evaluation. Airlangga explained that the President approved several programs related to national economic recovery (PEN) with a budget of Rp 451 trillion. The budget is divided into three sectors, namely health, social protection and fiscal facilities for several sectors. "What the President has approved is that the property fiscal initiative or VAT DTP will be extended until June 2022," he said. DTP VAT for flats and landed houses for a maximum of Rp 2 billion, will be given a DTP VAT facility of 50 percent. Then for residential prices sold from Rp. 2 billion to Rp. 5 billion, you will get a VAT facility of 25 percent. "This DTP VAT will be calculated from the start of the contract and it is hoped that the construction of the house can be completed within 9 months," Airlangga added. However, Airlangga on the occasion did not specify how much funds were allocated by the government for VAT incentives for the property sector DTP this year.

Repayment Limit Relaxed: Refunds Deflate Tax Target

The easing of provisions for tax restitution or refunds is enshrined in Minister of Finance Regulation (PMK) No. 209/PMK.03/2021 concerning the second amendment to PMK No. 39/PMK.03/2018 concerning Procedures for Preliminary Refund of Excess Tax Payments.
In this regulation, the government adjusts the limit for overpayment of Value Added Tax (PPN) refunds for Taxable Entrepreneurs (PKP) who meet certain requirements as taxpayers to Rp5 billion. This limit figure is much higher than the previous provision which was only Rp. 1 billion. This condition opens the opportunity for more taxpayers who are included in the PKP to apply for tax refunds or refunds. This policy also risks depleting potential tax revenues, which this year is targeted to reach Rp1,265 trillion as stated in the 2022 State Revenue and Expenditure Budget (APBN). A member of the Indonesian Chamber of Commerce and Industry (Kadin) for Monetary Policy and Financial Services, Ajib Hamdani said, the restitution policy increases the government's fiscal risk because the reduction in tax revenue has the potential to be even greater. "This restitution will be a direct deduction from existing tax revenues," he told Bisnis last weekend. According to him, without any easing of regulations, the potential for an increase in restitution this year is quite large in line with the need for fiscal assistance to the public and the business world to maintain the momentum of economic recovery.
